In order for the buyer to notarize a sales contract for immovable property they are purchasing with the Notary, the following documentation is required:

• a copy of an APR excerpt – (The Serbian Business Register)
• D of the signatory
• a building permit for the building under construction
  (if the subject of the purchase is a apartment or a building under construction)
• title deed
  (if the subject of the purchase is apartment or a building under construction, the buyer will need a title deed for the land plot on which it is built, and if the subject of the sale is an already registered apartment or a business premise, then the buyer needs a title deed for that apartment or the business premise)

The buyer becomes the owner of the apartment only after the apartment being registered in the land registry, and after the building, in which the apartment is located, is also registered.

A natural person who is also a Serbian citizen, resides in Serbia, and has never owned a property before has the right to a value added tax refund under the following conditions:

1. dthat, as of 1st July 2006 until the date when the notarization of the purchase contract, which serves as the basis for the purchase of their first ever apartment, they had not been owners or co-owners of a apartment on the territory of the Republic of Serbia;
2. – that they paid the full agreed price of the apartment, VAT included, to the seller.

This right can be exercised only on the basis of a purchase contract for the aparment which has been notarized after the entry into force of the Law on Amendments and Supplements to the Value Added Tax Act (“Official Gazette of the Republic of Serbia”, No. 61/05), or on the basis of a purchase contract notarized after 8th July, 2007 for the apartment which square footage is up to 40 m², plus up to 15 m² for each household member who had never owned or co-owned a apartment on the territory of the Republic of Serbia in the period from 1st July, 2006 to the day of the notarization of the purchase contract.

If the first-time buyer purchases a apartment is that exceeds 40 square metres, they are eligible to a VAT refund to the amount corresponding to 40 square metres. The duration of the joint residence prior to the notarization date of the purchase contract stipulating the buyer purchasing the apartment for the very first time has no bearing on the eligibility for a VAT refund.

More detailed information and required documents

After the notarization of the purchase agreement, you will have to register as the new owner of the apartment, with the notarized agreement, with the utility companies that supply energy products or services to the apartment in question (EPS Snadbevanje, JKP Informatika, JKP Novosadska toplana, DP NOVI SAD GAS, Telekom Srbija etc.), as well as with the City Tax Administration, which will determine the property tax.

Once being issued with a building permit, the developer is obligated to register the commencement of construction work to the relevant inspection authorities at least 8 days prior to the commencement. The construction work is carried out in several stages with until the constructed facility is fit for the issuance of the use permit.

The next stage is drafting a flooring plan which is a drawing of the special segments of the building showing the final constructed area of ​​all residential and commercial spaces in the entire building. Then, the developer organizes the technical reception of the facility, and the Technical Reception Commission (after a detailed inspection of the facility) prepares a report with a proposal to issue a use permit.

After the use permit, which is issued at the developer’s request by the City Urban Planning Directorate, the facility is ready for registration.

The City Urban Planning Directorate sends, ex-officio, the permit to the relevant cadastre office that carries out registration of the entire building and all of its special segments. After this step is finished, the individuals who purchased apartments in the building can proceed with the registration of their apartments.
